How to Apply for a Transfer Of Ownership

  • Prepare Required Documents: See the Requirements below.
  • Pay the Transfer Tax: Before transferring ownership, the Transfer Tax must be paid at the local treasury office or Bureau of Internal Revenue (BIR), depending on your locality. The amount of transfer tax will depend on the property's value or selling price.
  • Secure a Tax Clearance and BIR Certificate of Tax Payment (if required): Obtain the Certificate Authorizing Registration (CAR) from the BIR to confirm that the required taxes have been paid for the transaction. This includes the payment for the Documentary Stamp Tax and Capital Gains Tax (if applicable).
  • Notarize the Deed of Transfer: Have the Deed of Sale or Deed of Donation notarized. Notarization is important to make the transfer legally binding and recognized by the government.
  • Submit Documents to the Local Assessor's Office: Submit the required documents, including the notarized deed and tax clearance, to the local assessor's office or registry of deeds. You will need to submit the documents for the official update of property ownership records.
  • Submit to the Registry of Deeds: Take the notarized Deed of Sale or Deed of Donation, together with the Tax Clearance, CAR, and other documents, to the Registry of Deeds for registration. This step legally updates the property title under the new owner's name.
  • Pay Registration Fees: Pay the necessary registration fees at the Registry of Deeds. The fee is typically a percentage of the property's value or the selling price, as specified by local regulations.
  • Wait for the New Title: After processing, the Registry of Deeds will issue a new Certificate of Title or Tax Declaration in the name of the new owner. The process may take a few weeks to complete.
  • Update Local Records: If necessary, update the local assessor's office with the new title or tax declaration. This ensures that the local government has accurate records for tax assessment and other official purposes.
  • Receive the New Title or Tax Declaration: Once the process is completed, you will receive the official new Certificate of Title or Tax Declaration in the name of the new property owner, completing the transfer of ownership.
